We grant you a limited, non-exclusive, non-transferable, and revocable license to use PromptIQ in accordance with these Terms for your personal, non-commercial use.

2.2 Restrictions

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to discover the source code or underlying algorithms
• Modify, translate, adapt, or create derivative works of the Service
• Copy, distribute, rent, lease, lend, or sublicense the Service
• Use the Service for any commercial purpose without authorization
• Remove or alter any proprietary notices, labels, or marks on the Service
• Use the Service in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service to develop competing products or services

3. User Conduct

You agree to use the Service in a responsible manner and comply with all applicable laws and regulations. You further agree not to:

• Upload, post, or transmit content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable

• Upload or transmit viruses, malware, or any code of a malicious nature
• Spam, phish, or engage in any form of fraud or deception

The Service, including all content, features, and functionality, is owned by Cloudgen Consulting, our licensors, or other providers of such material and is protected by copyright, trademark, and other intellectual property laws.

You retain all rights to the prompts and content you input into the Service. By using the Service, you grant us a limited right to process and analyze your prompts locally to provide the Service functionality.

If you provide feedback, suggestions, or improvements to the Service, we may use such feedback without restriction or compensation to you.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement

9.1 Termination by You

You may terminate your use of the Service at any time by uninstalling the application or ceasing to access the website.

9.2 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Causes for termination include, but are not limited to:

• Violation of these Terms
• Unauthorized or fraudulent use of the Service
• Harmful or malicious conduct
• Spam or abuse

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any legal proceeding, you agree to attempt to resolve any dispute informally by contacting us at legal@promptiq.app.

13.2 Arbitration

Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in English and decided by a single arbitrator.

13.3 Class Action Waiver

You agree that any dispute shall be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

14. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, or if such modification is not possible, that provision shall be severed. The remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior and contemporaneous agreements, understandings, and communications.

While we strive to provide accurate and helpful prompt optimization, we do not guarantee any specific results. Token reduction and optimization effectiveness depend on various factors including the complexity of your prompts and the AI model you're using.

20. Support and Maintenance

We provide the Service on an "as-is" basis. We may provide updates, patches, or bug fixes at our discretion, but we are not obligated to provide ongoing support, maintenance, or updates.
